1. Agreement to Terms
By accessing or using RootPit ("the Platform," "we," "us," or "our") at rootpit.com or any associated subdomains, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and RootPit. Your continued use of the Platform following any modification to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
RootPit is an independent, third-party discovery and listing platform that aggregates publicly available information about applications ("Apps") and communities ("Communities") built on the Root platform (rootapp.com). RootPit is not affiliated with, endorsed by, sponsored by, or officially connected to Root, Rootapp, Inc., or any of their subsidiaries or affiliates.
RootPit provides:
- Discovery and listing services for Root-ecosystem Apps and Communities
- A public voting and review system for listed content
- Developer and community submission tools
- Optional paid promotional features for listed developers and community administrators
3. Eligibility
You must meet all of the following conditions to use the Platform:
- Be at least 13 years of age. If you are between 13 and 18 years of age, you must have verifiable parental or legal guardian consent.
- Not be barred from receiving services under the laws of the United States or any other applicable jurisdiction.
- Not have previously had your account terminated by RootPit for violation of these Terms.
By using the Platform, you represent and warrant that you meet all eligibility requirements stated above.
4. Accounts
4.1 Registration
Certain features of the Platform require account registration. You agree to provide accurate, current, and complete information during registration and to keep such information updated. You are responsible for maintaining the confidentiality of your account credentials.
4.2 Account Security
You are solely responsible for all activity that occurs under your account. You must notify us immediately at legal@rootpit.com if you suspect unauthorized access to your account. RootPit will not be liable for any loss resulting from unauthorized use of your account.
4.3 Account Termination
RootPit reserves the right to suspend or permanently terminate any account, with or without notice, for any violation of these Terms or conduct that we determine, in our sole discretion, to be harmful to the Platform, its users, or third parties.
5. User Content
5.1 Definition
"User Content" means any content you submit, post, upload, or otherwise make available on the Platform, including but not limited to: listing submissions, descriptions, screenshots, icons, reviews, comments, votes, and profile information.
5.2 License Grant
By submitting User Content to the Platform, you grant RootPit a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the operation and promotion of the Platform.
You retain all ownership rights in your User Content. The license above terminates when you delete your User Content from the Platform, except to the extent your content has been shared by others or we are required to retain it by applicable law.
5.3 Content Standards
You represent and warrant that your User Content does not:
- Infringe any third-party intellectual property right, including copyright, trademark, patent, or trade secret
- Violate any applicable law or regulation
- Contain material that is unlawful, defamatory, obscene, pornographic, hateful, discriminatory, or harassing
- Contain malicious code, viruses, spyware, or any software intended to damage or gain unauthorized access to systems
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Constitute unsolicited commercial communications or spam
- Contain false, misleading, or deceptive information regarding an App, Bot, or Community
5.4 Content Removal
RootPit reserves the right, but not the obligation, to remove, edit, or refuse any User Content at any time and for any reason without liability to you.
6. Listing Submissions
6.1 Submission Requirements
When submitting an App, Bot, or Community listing, you represent and warrant that:
- You are the owner or an authorized representative of the listed App, Bot, or Community
- All information provided in the listing is accurate and not misleading
- The listed App, Bot, or Community complies with Root's developer terms and policies
- The listing does not violate any third-party rights
6.2 Listing Accuracy
You are solely responsible for keeping your listing information current and accurate. RootPit does not verify listing information and is not responsible for inaccuracies.
6.3 Listing Removal
RootPit may remove any listing at any time without notice, including for inaccuracy, policy violation, or at the request of the underlying App, Bot, or Community owner.
7. Voting and Reviews
7.1 Authenticity
Votes and reviews must reflect genuine user experience. The following are strictly prohibited and may result in immediate account termination:
- Vote manipulation, including automated voting, coordinated voting schemes, or incentivized votes
- Submitting reviews for Apps, Bots, or Communities in which you have an ownership or employment interest without clear disclosure
- Submitting false, fabricated, or defamatory reviews
- Purchasing, selling, or trading votes or reviews
7.2 Dispute of Manipulated Votes
RootPit reserves the right to remove votes or reviews that we determine, in our sole discretion, to be inauthentic, manipulated, or in violation of these Terms.
8. Paid Features and Payments
8.1 Paid Services
RootPit offers optional paid promotional features, including but not limited to: Featured Listings, Developer Pro subscriptions, Promoted Discovery placements, Community Boosts, and Agency Plans (collectively, "Paid Services").
8.2 Billing
By purchasing any Paid Service, you authorize RootPit to charge your designated payment method for the applicable fees. All fees are in United States Dollars unless otherwise stated. Subscription fees are billed in advance on a recurring cycle (monthly or annually, as selected).
8.3 Refund Policy
All fees paid for Paid Services are non-refundable except as expressly required by applicable law or as stated at the time of purchase. In the event RootPit terminates your access to Paid Services without cause, we will provide a pro-rated refund for the unused portion of the current billing period.
8.4 Price Changes
RootPit reserves the right to modify pricing for any Paid Service at any time. Changes to subscription pricing will be communicated via email no less than 14 days before taking effect. Your continued use of the Paid Service after a price change constitutes acceptance of the new pricing.
8.5 Cancellation
You may cancel any subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to Paid Services through the end of the paid period.
9. Prohibited Conduct
You agree not to engage in any of the following:
- Using any automated system, bot, scraper, or spider to access or extract data from the Platform without express written permission
- Attempting to gain unauthorized access to any portion of the Platform or its infrastructure
- Interfering with or disrupting the integrity or performance of the Platform
- Circumventing or attempting to circumvent any technical measures implemented by RootPit
- Reverse engineering, disassembling, or decompiling any part of the Platform
- Using the Platform for any illegal purpose or in violation of any local, national, or international law
- Harassing, threatening, or intimidating other users of the Platform
- Creating multiple accounts for the purpose of circumventing bans or restrictions
10. Intellectual Property
10.1 Platform Ownership
The Platform and its original content, features, functionality, design, logos, trademarks, and trade dress are and will remain the exclusive property of RootPit and its licensors. Nothing in these Terms grants you any right to use the RootPit name, logo, or other brand identifiers without our prior written consent.
10.2 Third-Party Intellectual Property
All App names, logos, descriptions, and associated materials displayed on the Platform are the property of their respective owners. Display of such content on the Platform does not imply endorsement or affiliation.
10.3 Copyright Infringement
If you believe any content on the Platform infringes your copyright, please submit a notice to legal@rootpit.com containing: (i) identification of the copyrighted work, (ii) identification of the infringing material and its location on the Platform, (iii) your contact information, (iv) a statement of good faith belief, and (v) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the copyright owner.
11. Third-Party Links and Services
The Platform may contain links to third-party websites or services, including rootapp.com. These links are provided for convenience only. RootPit does not endorse and is not responsible for the content, policies, or practices of any third-party website or service. Your use of third-party services is governed by their respective terms and policies.
12. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
ROOTPIT DOES NOT WARRANT THAT: (I) THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (II) ANY DEFECTS WILL BE CORRECTED; (III) THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (IV) THE RESULTS OF USING THE PLATFORM WILL MEET YOUR REQUIREMENTS.
ROOTPIT MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY LISTING INFORMATION.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROOTPIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ROOTPIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL ROOTPIT'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM EXCEED THE GREATER OF: (I) THE TOTAL AMOUNT PAID BY YOU TO ROOTPIT IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (II) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
14. Indemnification
You agree to defend, indemnify, and hold harmless RootPit and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your use of the Platform; (ii) your User Content; (iii) your violation of these Terms; (iv) your violation of any third-party right, including any intellectual property right or privacy right; or (v) any claim that your User Content caused damage to a third party.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
15.2 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
15.3 Class Action Waiver
YOU AND ROOTPIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15.4 Informal Resolution
Before initiating arbitration, you agree to first contact us at legal@rootpit.com and attempt to resolve the dispute informally for a period of 30 days.
16. Changes to Terms
RootPit reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this document and, where required by applicable law, notify you by email or prominent notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and RootPit regarding the Platform and supersede all prior agreements, representations, and understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
17.3 Waiver
Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
17.4 Assignment
You may not assign or transfer any rights or obligations under these Terms without our prior written consent. RootPit may freely assign these Terms without restriction.
17.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and RootPit.
